Personal data

Application process

As a rule, you can use our online services without revealing your identity. When you fill out a form on our website, or when you request information from us, we will ask you for your name and other personal information or obtain such data from third parties, such as referral partners or any agent appointed by you. You are free to choose whether to disclose this information to us or not. You may need to provide us with certain personal information from time to time in order to fully use our website and services and throughout our online process should you wish to apply for EVO products and service. This information could include information such as your date of birth and address and could be protected by applicable data privacy laws. By disclosing any personal information you are consenting to the collection, use and transfer of your personal information under the terms of this Privacy Policy, and are confirming agreement with our disclosure of such information to both our affiliated companies and to third party service providers for their processing.

If you give us information about another person, in doing so you confirm that they have given you permission to provide it to us to enable us to process their personal information and also that you have told them who we are and what we will use their data for, as set out in this Privacy Policy. All information is stored on specially protected servers in Germany or Poland. Access to this data is given to only a few specially authorised persons who are responsible for the technical, commercial or editorial maintenance of the servers. These authorised persons may be located in the UK, within the EEA or located outside of the EEA, including the U.S.

We and these authorised persons shall use your personal information only for the purposes for which it was provided to us and in compliance with laws and regulations. Processing purposes could include due diligence, anti-money laundering verifications and ‘Know Your Customer’ confirmations.

Your rights, storage and transfer of personal information to third parties

According to the regulations of the Act, visitors to our website are informed each time personal data is collected. Order processing

If, in the course of order data processing, data is forwarded to service providers (e.g., KYC/AML vendors), other entities of EVO (e.g., U.S. affiliates of EVO) and their partners (e.g., financial institutions) with your consent, they too are bound to observe the Act, other legal requirements and, by contract, this Privacy Policy. If forwarded to countries outside the European Economic Area, including the United States of America, which may not have laws comparable to those in the European Union to protect your personal information, we will be responsible and will ensure that your personal data continues to be protected with the same level of protection as if we were dealing with it directly; we have EU Model Contract Clauses in place with many of these non-EEA companies. We will transfer your data to authorities only if we are legally obliged to or ordered by a court of competent jurisdiction to do so.

We may disclose your personal data to third parties: (a) in the event we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets; (b) if EVO or substantially all of its assets are acquired by a third party, in which case personal data held by us about our customers will be one of the transferred assets; (c) if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply the terms of this Privacy Policy or any other agreements; or (d) to protect the rights, property or safety of EVO, our customers or others (this includes exchanging information with other companies and organisations for the purposes of fraud prevention and credit risk reduction).

Data relating to your internet access is logged by our servers. This data could be used to identify you (for example, your IP address, the date and time and the pages that you viewed). We do not exploit any personal data. We reserve the right to use anonymous data records for statistical purposes, to improve our websites and to better meet the needs of visitors to our websites. These are stored in your browser and help to deliver a better and more personalised service, e.g., by remembering certain choices you’ve made so you don’t have to re-enter them.
